A former North Strabane Township police officer who was dishonorably dismissed and had under 20 years of service was not eligible for early retirement benefits, the Pennsylvania Commonwealth Court upheld. The officer alleged that he requested a deferred vested benefit in lieu of an early retirement pension, and despite the fact that the court here said the court was wrong in analyzing the official’s request as part of a provision of the pension plan to address retirement benefits after 20 years of service instead of 12, but the denial of benefits was reasonable because of his disqualifying dishonorable dismissal.
